1.1 The business relationship between Next Germany GmbH (hereinafter referred to as "Next" or "We") and you (hereinafter referred to as "You") is governed exclusively by the following General Terms and Conditions (hereinafter referred to as "GTC") in the version valid at the time of the order. These GTC also contain legal information for consumers in accordance with the provisions on distance selling and electronic commerce contracts.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for a purpose that is predominantly neither commercial nor self-employed (Sec. 13 German Civil Code).
1.3 You must be over 18 years of age and reside in the European Union in order to purchase goods on our website https://www.next.at/de.
1.4 Any deviating terms and conditions you may propose will not be recognised unless we expressly agree to their validity.
1.5 Your contractual partner for contracts concluded on the website https://www.next.at/de is Next Germany GmbH, Zielstattstr. 40, c/o BDO AG Wirtschaftsprüfungsgesellschaft, D-81379 Munich.
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. The contract is concluded by completing the order process, which we will outline below.
2.2 You can select a product from our product range and you can collect these products in the so-called empty shopping basket (bag) by clicking on the "Add to bag"-button. By clicking on the "Checkout" button, you continue the ordering process. On this page, you must register with your customer details or create a customer account. By clicking on the "Buy now" button, you are submitting a binding offer to purchase the items collected in the empty shopping basket. Before completing the order, you can change and view the order details at any time.
2.3 However, the offer can only be submitted and sent if you accept the validity of these GTC by clicking on the respective box.
2.4 We will then send you an automatic confirmation of receipt by e-mail, listing your order. You can print this out using the "Print" button. The automatic confirmation of receipt merely documents that we have received your order. It does not constitute our acceptance of the order.
2.5 The contract is only concluded when we confirm acceptance of the offer by separate email (order confirmation) or when the ordered goods are dispatched. The contract documents are stored in compliance with data protection regulations. You can download these GTC from the website together with the cancellation policy and the form as a PDF file.
2.6 The contract is concluded in German and English.
2.7 If you have selected prepayment, the contract is concluded when the bank details and payment request are provided. We have the right to withdraw from the contract if the payment is due and we have not received payment within 10 calendar days of sending the order following a payment reminder. This withdrawal will have the effect that the order is invalid and we are not obliged to deliver the goods anymore. Reservations for items paid for in advance are therefore valid for a maximum of 10 calendar days.
3.1 All prices stated on our website are total prices in Euro, including the applicable statutory value added tax.
3.2 In addition to the prices stated, we charge shipping costs for delivery. The shipping costs are also clearly communicated to you on a separate information page and during the ordering process. For orders under 40 €, shipping costs of 4.00 € per order apply. Shipping is free for all orders with a total order value of 40 € or more. Next reserves the right to supplement or change this free shipping offer at any time for future orders.
3.3 We reserve the right to increase or decrease the prices of our products at any time prior to the conclusion of the contract.
3.4 We reserve the right to refuse or accept orders at any time.
4.1 The applicable delivery times are displayed on the respective product page and during the checkout process.
4.2 If not all of the products ordered are in stock and this is expressly stated in the respective item description, we are entitled to make partial deliveries, provided this is reasonable for you. The parts of the order that are available at a later date will be delivered to you within the delivery time stated on the respective item page. If there are unforeseen delivery delays for parts of the goods that are not mentioned in the item description, we will inform you immediately. In this case, you are free to withdraw from the contract or agree to one or more partial deliveries.
4.3 If prepayment has been agreed, delivery will be made after receipt of the invoice amount. In all other cases, we will ship the ordered products in good time so that they are delivered to you within the agreed delivery time.
5.1 You can choose from the available payment methods during and before completing the order process. You can pay with Visa, Mastercard, AmEx, Maestro, Diners, Klarna and PayPal. Which payment methods are offered is at our sole discretion and depends in particular on the value of the goods, the contents of the shopping basket and the identity of the customer. In specific cases we may also reject individual payment methods after you have submitted your order; this particularly applies if we are aware of a customer's poor credit rating. In this case, you can decide whether you wish to pay using another payment method or whether the order should be cancelled.
5.2 We cannot accept credit cards that expire within the next five (5) days. Credit cards are verified by a third-party provider and goods will be delivered once approval has been granted by the provider.
5.3 If you choose Klarna as your payment method, you will receive an email directly from Klarna with an invoice for payment. Please check your registered email address regularly. Please note that a payment limit will apply if you choose Klarna which may vary for each customer. For more information, please visit www.klarna.com.
5.4 Certain special offers are not available when paying with Apple Pay Express Checkout.
5.5 The delivered goods remain our property until full payment has been received.
5.6 You are only entitled to offset if your counterclaims have been legally established or recognised by us.
6.1 As a consumer, you have a statutory right of withdrawal when concluding a distance selling transaction, about which we inform you below in clause 6.1 in accordance with the statutory model. A model withdrawal form can be found in clause 6.2. Exceptions to the right of withdrawal are regulated in clause 6.3.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online. If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by email), including its content and the date and time of its submission, without undue delay.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. We will bear the cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

6.3 Exceptions to the right of withdrawal
The right of withdrawal does not apply to:
7.1 In addition to the statutory right of withdrawal described in clause 6, we grant you an additional contractual right of withdrawal (so-called right of return). This allows you to return the items within 28 days of receipt. You will receive a full refund of the purchase price if the item is in its original unused condition and has the original label attached. This right of return does not apply to jewellery, cosmetics, care products, photo products, food products or gift vouchers. You can return your items using the return label on the back of your delivery note. Please note that a shipping cost of €5.50 will be deducted from your refund. Items cannot be returned to a Next Store. The right of return applies in addition to your statutory warranty claims and the statutory right of withdrawal. Unless otherwise specified in this clause 7, Sections 355, 356, 357, 358, 359 and 312g (2) of the German Civil Code (BGB) apply accordingly to this additional contractual right of withdrawal (right of return).
We are liable for material defects in accordance with the statutory provisions.
9.1 We shall be liable without limitation in accordance with the statutory provisions for claims under the Product Liability Act (ProdHaftG), in the event of injury to life, limb or health, for a defect after assumption of a guarantee, for the quality of the product and for intent and gross negligence. This includes liability for intentional acts and gross negligence on the part of our legal representatives and vicarious agents. In addition, we are liable in accordance with the statutory provisions in the event of intentional or negligent breach of a so-called cardinal obligation. Cardinal obligations refer to an obligation whose fulfilment is essential for the proper execution of the contract and on whose compliance you regularly rely.
9.2 In the event of a slightly negligent breach of the cardinal obligations defined in clause 9.1, our liability shall be limited to the typically foreseeable damage.
9.3 Besides the above, we are not liable.
9.4 Insofar as our liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.
10.1 All sale and clearance items are subject to availability.
10.2 The "Next Day Delivery" shipping option is not available for sale or clearance items.
10.3 Delivery of sale and clearance items in stock can take up to 21 days. The specific delivery time will be communicated to you during the order process and on the product pages.
10.4 The special terms and conditions for sale/clearance items only apply to items listed on the "Clearance" page. They do not apply to items listed on the main page.

13.2 This offer is valid until the date specified in your notification. The offer can only be used after entering the voucher PIN on nextdirect.com. Voucher PINs can only be used once. The offer can only be used for online purchases on nextdirect.com. It does not apply to orders by telephone. The use of the offer requires a registration on nextdirect.com. The offer only applies to the first order by new customers on nextdirect.com. Per customer only one voucher PIN may be used. A refund of the offer price in case of a return of the order is not possible. The voucher PIN may not be exchanged for cash. A change or refund is not possible. Next does not assume any responsibility if you lose the voucher PIN. In this case you will neither receive a new voucher PIN nor will you be refunded the value. Your statutory rights will not be affected thereby.
We do not participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (VSBG) and are not obliged to do so.
15.1. You can print out the contract text before submitting your order to us by using the print function of your browser in the last step of the order process.
15.2. We will store the contract text in digital form for the purpose of processing the contract and retain it for 3 years.
16.1 The law of the Federal Republic of Germany applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular those of the country in which you as a consumer have your habitual residence, remain unaffected.
16.2 The place of jurisdiction and place of performance is our registered office if you are a merchant, a legal entity under public law or a special fund under public law.
